An organisation that publicly promotes or identifies itself in writing as offering a service, is licenced to deliver a service, assigns personnel and/or space to a service, or allocates financial resources to a service is considered to offer that service.

  INDEMNIFICATION

Protection for the directors, officers, board members, personnel, and volunteers of an organisation against any civil or criminal action, suit, or proceeding resulting from their activities with the organisation. Indemnification should include all reasonable expenses, including legal fees, except when it is determined that the person is liable for negligence or misconduct in the performance of his or her duties. Organisations generally will have an indemnification clause in their bylaws, whether or not external insurance coverage has been purchased to cover such risks as may be involved.

  EMPLOYEE

Paid member of an organisation. Foster parents are not considered employees and are specifically referenced in relevant standards.

  GOVERNING BODY

A person or persons with the legal authority and responsibility to set policy and oversee the operations of an organisation. Generally, the governing body is a group, such as a board of directors or board of trustees. While the exact responsibilities of the governing body depend on the nature and character of the organisation, the governing body has minimum fiduciary responsibilities to the organisation set by Letters Patent, statute, regulation, and case law, and typically assume responsibilities for long term planning, risk management, and evaluation and effectiveness of management.

  PERSONNEL

The body of employees and/or volunteers that carries out the organisation’s tasks under the organisation’s administration and/or supervision. This definition does not include foster parents who are specifically referenced in relevant standards.

CA-RPM 4: Insurance Protection

 
The organisation is adequately insured.

CA-RPM 4.01

 
The organisation annually assesses insurance needs, and obtains coverage that is commensurate with the scope and complexity of its services.

Interpretation: Relevant types of insurance can include:

  1. general liability;
  2. workers’ compensation;
  3. employment insurance;
  4. fire and theft;
  5. supplemental health coverage;
  6. indemnification;
  7. professional liability;
  8. officer’s or director’s liability;
  9. automobile liability;
  10. property and casualty;
  11. malpractice; and
  12. bonding or other forms of employee theft insurance, as appropriate, for all staff and governing body members who sign cheques, handle cash or contributions, or manage funds.

Governing body members and personnel receive a written description of the organisation's insurance coverage.
